You may be right, I'm not qualified enough to say which approach is correct.

Nevertheless, Nero AAC encoder has this option:

-ignorelength : Ignores length signaled by WAV headers of input file.
                Useful for certain frontends using stdin.

Even with this option, the file length must be >= 36.
