Since all the source code is always available under GPL that is not
true, it would be pointless (since that way you'd only make use
of the GPL permissions and not those of the commercial license),
but I can see no legal issue.
I'm not an expert but I'd consider this a reasonable change so far,
even though a bit ugly, maybe the check should be split in two parts.
