I may misunderstand you but I believe your 
understanding is not correct.

If you configure FFmpeg with --enable-nonfree you 
cannot legally distribute the resulting binaries.

(If you are using --enable-nonfree but no other 
configure option, the best solution to get a 
binary that you are allowed to distribute is 
to simply remove --enable-nonfree from your 
configure line.)
