You win;-))

If I understand correctly, lame contains GPL code 
by default without telling...

Since FFmpeg does not (never) use that code, you 
can simply disable it when compiling lame to 
be on the safe side:

$ configure --disable-decoder

Allow me to repeat that this does not change the 
abilities of your resulting FFmpeg binary.
